PERANAN THE INTERNATIONAL COMMITTEE OF THE RED CROSS (ICRC) DALAM MEMBERIKAN PERLINDUNGAN BAGI TAHANAN YANG BERHUBUNGAN DENGAN KONFLIK DI TIMOR-TIMUR SEBELUM 1999

ABSTRACT
Humanitarian Law violations in East Timor can not be separated from the
factor of Indonesia (TNI) military troops who wanted to seize the sovereignty of
the Democratic Republic of East Timor in Unilateral independence was
proclaimed on 28 November 1975 by the Fretilin Party (Revolutionary Front for
Independence of East Timor), which for the Indonesian government is separatist
movement. The conflict in East Timor before 1999 resulted in casualties in large
numbers, in addition to casualties who were killed, many injured victims. Plus the
number of missing persons in conflict situations such as kidnapping and murder,
forcible transfer of population from their homes of origin to other places. In
August 1979, the ICRC started emergency relief operations. For the formulation
of the problem posed is what the role of the ICRC in providing protection for
conflict-related prisoners TNI / RI-FALINTIL in East Timor previous to 1999 and
the constraints faced by the ICRC in carrying out humanitarian tasks in East
Timor prior to 1999?. This study aims to determine the role of the ICRC in
providing protection for conflict-related prisoners TNI / RI-FALINTIL in East
Timor prior to 1999 and the constraints faced by the ICRC in carrying out
humanitarian tasks in East Timor prior to 1999. This type of research used in this
study is library research, which continued with emperies legal research, said the
normative legal research because this research will utilize secondary data, which
would then be followed by empirical research.
The International Committee of the Red Cross (ICRC) arrived in East
Timor since 1975 but was limited to observation and the ICRC began activity in
August 1979. Protection or protection if there actually was a prisoner of war,
political prisoners, civilians or people who are not involved in the fighting which
was detained by the TNI and Falintil. The ICRC does not have a definitive list
because often people who become prisoners were free, but from the family did not
inform the ICRC .The family has learned that members of theirs family was dead
even know the grave but still reported to the ICRC, the geographical conditions
also become an obstacle for the ICRC in carrying out their duties because if it
rains then the ICRC was unable to reach all areas of East Timor, the security issue
for the ICRC delegates and local employees, not absolute dialogue with the
warring parties, financial problems, but then can be overcome because each year
the ICRC always make a appeal of funds to the countries members of Geneva
convention. At the time of the conflict happened in East Timor, Indonesia has not
ratified the additional protocol II, 1949 Geneva convention is one of obstacle to
the ICRC, as the ICRC can not easily run a humanitarian mission.
