PERLINDUNGAN HUKUM INVESTOR PADA PENGELOLAAN REKSA DANA DALAM SISTEM PASAR MODAL INDONESIA

ABSTRACT

Mutual Fund is one of ways to invest in the capital market. However, at this time many people are not aware about the legal protection of the can where the Fund invests. The purpose of this study was to analyze the legal protection of investors in the management of the Fund in Indonesia Capital Market system and legal actions that can be taken by mutual fund investors in case of loss due to negligence of the Investment Manager in Indonesia Capital Market system. The nature of research is normative empiric. This study uses library research and field research. Sampling technique using purposive sampling technique. Techniques of data collection using interviews and data collection tool in the form of an interview guide. Data analysis techniques using qualitative descriptive analysis. The results showed that the legal protection to investors in the management of Mutual Fund has been set in the Capital Market Law and BAPEPAM. In the Capital Market Law legal protection provided for in Article 35, 36.37. Civil protection is also given to those provided for in Article 111 of Law Capital Markets. BAPEPAM regulations stipulated in the Investment Manager's behavior and guidelines in order to record the decision making by the Investment Manager. Remedies can be taken by investors suffered losses when the negligence of the Investment Manager is implemented deliberative process first. Investors also can file a lawsuit to the court accompanied by strong evidence. For the Investment Manager to be committing negligence, it can be penalized in accordance with the rules, in the form of administrative sanctions and criminal sanctions.
