ABSTRACT

The primary function of banks in Indonesia is to collect and distribute people‟s fund. In channeling the public‟s funds, banks give loans to the people. As giving loans is a very risky business, banks need to be cautious and carefully implement the principles of credit risk management, one of which is prudent loan giving. Prudent banking principle is regulated by the Banking Act No. 7 of 1992 which is later amended by the Banking Act No. 10 of 1998 as defined in its chapter 2, 8, 11,16, 29 and in its general notes. The problem formulation in this research is set to investigate how Katamso Yogyakarta Branch of BRI applied the prudent banking principle in giving the Kredit Usaha Rakyat or Loans for People‟s Businesses to its customers and to see how the Bank dealt with non performing loans in case it still happens after the implementation of prudent banking principle. This research is a normative law research, as the data obtained is systematically and logically analyzed. There are two types of data used in this research. The first is primary data which is obtained from on field interview, and the second is secondary data obtained from researches using documentary study. After the data is evaluated, it is then analyzed qualitatively to be presented in a descriptive report. The research reveals that in channeling the Loans for People‟s Businesses, Katamso Yogyakarta Branch of BRI applies the prudent banking principle as regulated by article 2 of Banking Act 10 of 1998. The principles are materialized in the form of its policy to raise the collateral for Loans for People‟s Businesses by 30%. This is a measure to mitigate the risk of credit default, due to the fact that the government will only cover 70% of loss when the loan is in default. The first method done by the bank when a debtor of Loans for People‟s Businesses has a loan that is in default or close to being in default is to repeatedly visit the debtor to persuasively make him/her pay back the loan, while the second method is to scrutinize credit analysis on the business owned by future debtors.
